Terms of Use Agreement – Introduction

Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal effects arising from your use of the store’s services via the Internet through this electronic platform. Any person’s use of the store—whether as a consumer of the store’s products or services or otherwise—constitutes full acceptance and approval, while possessing full legal capacity recognized by Sharia, regulations, and law, of all the terms and provisions of this agreement. This also confirms your commitment to comply with its rules and what is stated herein.

This agreement applies to all types of transactions between the consumer and the store. This agreement shall be considered effective and legally binding immediately upon your approval and commencement of registration in the store, in accordance with Article Ten of the Saudi Electronic Transactions Law.

Article One – Introduction and Definitions

The above introduction forms an integral part of this agreement. The following terms and expressions shall have the meanings assigned to them below:

(The Store): This term includes all forms of the store available on the Internet, whether as a mobile application, website, or physical commercial outlet.
(The Consumer): The person who engages in electronic commerce to obtain products or services provided by the store through its electronic platform.
(The Agreement): Refers to the terms and conditions of this agreement that govern and regulate the relationship between the parties to this agreement.

Article Two – Legal Capacity of the Consumer

The consumer acknowledges that they have full legal capacity recognized by Sharia and applicable regulations to deal with the store, or that they are at least eighteen (18) years of age.
In the event of violation of this article, the consumer shall bear all consequences of such violation before third parties.

Article Three – Nature of the Store’s Obligations

The store’s obligation towards consumers is to provide the product or service.
The store may provide additional services such as after-sales services or other related services depending on the nature and type of the requested product or service.

Article Four – Terms of Use

The consumer shall use the store’s electronic platform in compliance with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
The consumer undertakes not to use any product or service purchased from the store in any manner that violates public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.

Article Five – Accounts and Registration Obligations

Upon applying for membership in the store as a user, you are required to disclose specific information and choose a username and a confidential password for accessing the store’s services. By doing so, you agree to the following:

You are responsible for maintaining the confidentiality of your account information and password and agree to immediately notify the store of any unauthorized use or breach of your confidential information.
The store shall not be liable under any circumstances for any direct or indirect, material or moral losses resulting from the disclosure of the consumer’s username or password.
You undertake to use your account personally and bear full responsibility for it. Any use by others shall be deemed as authorization granted by you to such persons to use the store on your behalf.
You undertake to use the store with seriousness and credibility.
You undertake to provide true, accurate, current, complete, and lawful information about yourself as required during registration and to update such information whenever necessary.
The store undertakes to treat your personal information and contact details with strict confidentiality.
If it is determined that you have provided false, inaccurate, outdated, incomplete, or unlawful information, or information that violates this agreement, the store reserves the right to suspend, freeze, or cancel your membership or account without prejudice to its other legal rights to recover its rights and protect other consumers.
In case of non-compliance with any of the above, the store’s management reserves the right to suspend or cancel your membership or deny you access to the store’s services.

Article Six – Electronic Communications and Official Means of Contact

The parties to this agreement agree that communication shall be conducted via the registered email address on the platform.
The consumer agrees that all agreements, notices, statements, and other communications provided electronically shall be considered equivalent to written communications and shall constitute valid legal evidence fulfilling legal and Sharia requirements.
The consumer agrees that the store’s management may communicate and notify them of any matters related to this agreement or dealings through public announcements sent to all consumers or specific users.

Article Seven – Amendments to the Terms of Use and Fees

If any article or provision of this agreement is canceled or deemed unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
This agreement, as amended from time to time as required, constitutes the working mechanism and understanding between the consumer and the store.
The store may impose fees on some consumers depending on offers, products, services requested, or government-imposed fees or taxes.
The store reserves the right to add, increase, reduce, or discount any fees or expenses under this agreement for any consumer, regardless of the reason for registration.

Article Eight – Payment and Settlement Services

The store provides payment and settlement systems through its partners, allowing payments to be made fully online via available payment methods or any other method provided by the store from time to time.
The store undertakes to specify the price of the product or service in accordance with prevailing market value.
The store undertakes to provide invoices, receipts, and delivery notes for all amounts and profits generated and to provide the consumer with a purchase invoice.
The store undertakes to comply with recognized accounting standards in its electronic store in accordance with this agreement, for legal, economic, commercial, and regulatory interests.

Article Nine – Intellectual Property

All intellectual property rights of the store are fully owned by the store, whether acquired before or after the establishment of this electronic platform.
The consumer undertakes to respect the store’s intellectual property rights, including the store’s name, trademarks, logos, and other displayed symbols, all of which are fully protected intellectual property of the store.

Article Ten – Store Liability

The store undertakes to conduct its commercial activities through this platform in compliance with the applicable laws and regulations of the Kingdom of Saudi Arabia and in accordance with this agreement.
The store shall not be liable for any claims arising from errors or negligence, whether directly or indirectly, incidentally, or caused by the consumer or third parties such as shipping companies.
The store, its staff, owners, and representatives undertake that the products or services are lawful, authorized, and used for legitimate purposes in accordance with Saudi laws and regulations.

Article Eleven – Restriction or Termination of Access or Membership

The store may suspend or cancel the consumer’s membership or restrict access to platform services at any time, without prior notice and for any reason, without limitation.

Article Twelve – Governing Law

This Terms of Use Agreement is governed by and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject thereto.

Article Thirteen – General Provisions

If any provision of this agreement is canceled or deemed unenforceable, this shall not affect the validity of the remaining provisions, which shall remain effective until further notice by the store’s management.

This agreement, as amended from time to time, constitutes the full Terms of Use and the mechanism of operation, understanding, agreement, and contracting between the store and the consumer. Both parties agree to the following:

The Arabic language shall prevail in the interpretation of this agreement or any translation thereof.
All prices displayed for the store’s products or services are subject to change from time to time.
Promotional or marketing offers provided by the store are temporary, and the store reserves the right to modify or cancel them at any time.
The parties undertake to deal with each other in compliance with Sharia principles and the applicable laws and regulations.
This Terms of Use Agreement may only be terminated by a decision issued by the store’s management.
